A bill is on the Senate floor that would for the first time create a new zone of regulation between the water’s edge and the high water mark on the Great Lakes – and prohibits the state from regulating any vegetation removal in that zone (SB 1052). If the concept is adopted, proponents could argue that they also have the ability to limit any activity above the water’s edge including prohibiting the public from walking on the shores of the Great Lakes.
